By using, copying, transmitting, distributing or installing PicoBackup Outlook Express Edition, you agree to all of the terms of this License. If you do not agree to any of the terms of this License, then do not use, copy, transmit, distribute, or install this copy of PicoBackup Outlook Express Edition.

PicoBackup Outlook Express Edition is FREEWARE. Subject to the terms below, you are hereby licensed by Acubix to use this software without charge.

You may distribute copies of this software to anyone, provided it is not modified in any way. You are free to include copies of this software on CD-ROM or any other media providing that you do NOT charge the end-users for the software, and that you inform us at sales@picobackup.com describing when and how you wish to distribute the software. You may not repackage or make alterations to any file in the original PicoBackup Outlook Express Edition distribution. You are strictly prohibited from charging or request any form of payment, for any copies, however made, without prior written permission from Acubix. Acubix reserves the right to revoke the above distribution rights at any time.

You may not use, copy, emulate, clone, rent, lease, sell, modify, decompile, disassemble, reverse engineer, or transfer the licensed program, or any subset of the licensed program, except as provided for in this agreement. Any such unauthorized use shall result in immediate and automatic termination of this license and may result in criminal and/or civil prosecution.

This software, and all accompanying files, data and materials, are distributed "AS IS" and with no warranties of any kind, whether express or implied. The user must assume the entire risk of using this program. In no event shall Acubix, or its principals, shareholders, officers, employees, affiliates, contractors, subsidiaries, or parent organizations, be liable for any incidental, consequential, or punitive damages whatsoever relating to the use of PicoBackup Outlook Express Edition, or your relationship with Acubix.

In addition, in no event does Acubix authorize you to use PicoBackup Outlook Express Edition in applications or systems where this softwares failure to perform can reasonably be expected to result in a significant physical injury, or in loss of life. Any such use by you is entirely at your own risk, and you agree to hold Acubix harmless from any claims or losses relating to such unauthorized use.

This Agreement is the complete statement of the Agreement between the parties on the subject matter, and merges and supersedes all other or prior understandings, agreements and arrangements.

All rights of any kind in PicoBackup Outlook Express Edition which are not expressly granted in this License are entirely and exclusively reserved to and by Acubix. You may not rent, lease, modify, translate, reverse engineer, decompile, disassemble or create derivative works based on PicoBackup Outlook Express Edition. You may not make access to PicoBackup Outlook Express Edition available to others in connection with a service bureau, application service provider, or similar business, or use PicoBackup Outlook Express Edition in a business to provide backup services to others.
